Terms of Service

These Terms of Service apply to your access to and use of CheckHer, including its website, accounts, Experiences, comments, direct messages, reactions, voting, reporting, moderation features, and other functionality made available through the service.

By creating an account or using CheckHer, you agree to these Terms and to the Community Guidelines. If you do not agree, you must not use the service.

The person or legal entity operating CheckHer will be identified in the CheckHer Impressum. The Impressum forms the authoritative source for the operator's legally required identifying and contact information.

CheckHer is intended only for people who are at least 18 years old. You must not create or use an account if you are under 18.

You are responsible for providing accurate account information where requested, maintaining the security of your login credentials, and for activity performed through your account unless applicable law provides otherwise.

You must not impersonate another person, create an account in order to evade a suspension or ban, sell or transfer an account without permission, or use another person's account without authorization.

CheckHer provides a space for adults to describe, discuss, and reflect on their own dating and relationship experiences. Users may share positive and negative experiences, provided they follow these Terms, the Community Guidelines, and applicable law.

CheckHer does not verify every statement made by users and does not endorse a user's opinion merely because it appears on the service. Experiences, comments, messages, and other user submissions generally represent the views or recollections of the users who submitted them.

CheckHer must not be used as a tool to punish, threaten, intimidate, shame, stalk, expose, or coordinate harassment against another person.

You are responsible for the content you submit to CheckHer, including Experiences, comments, images, GIFs, profile information, direct messages, reports, and other material.

You should share only material that you have the right to share. When describing another person, distinguish your own experiences and opinions from factual claims. You must not knowingly submit false accusations, fabricated evidence, or materially deceptive content.

The fact that information, a photograph, or other material can be found publicly elsewhere does not automatically mean you have the right to republish it on CheckHer.

You must comply with the CheckHer Community Guidelines. In particular, you must not use CheckHer for unlawful content or conduct, harassment, threats, stalking, doxxing, publication of sensitive personal information, impersonation, spam, coordinated targeting, revenge behavior, or attempts to circumvent moderation.

Dating or relationship content involving a person under 18 must not be created, uploaded, or used to identify or depict that person on CheckHer.

Images, screenshots, private communications, and other media must be used only when you have the necessary rights and their use complies with privacy, personality, copyright, and other applicable rights.

You retain any rights you hold in content that you create and submit to CheckHer. You do not transfer ownership of your content to CheckHer merely by uploading it.

To the extent necessary to operate CheckHer, you grant the operator a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, format, and technically process your content for the purpose of providing, securing, moderating, and maintaining the service. This license is limited to what is reasonably necessary for those purposes and is subject to applicable law.

If content is deleted, copies may remain temporarily in backups, security records, moderation records, or where retention is required or permitted by law. This does not give CheckHer an unrestricted right to continue publicly displaying deleted content.

CheckHer may review content and account activity to enforce these Terms, the Community Guidelines, legal obligations, and the safety and integrity of the service.

Depending on the circumstances, moderation may include reviewing reports, restricting visibility or functionality, removing content, issuing temporary or permanent account restrictions, preserving moderation records, or taking other proportionate action.

Moderation may involve automated technical systems and human review where such systems are used. CheckHer may prioritize reports based on factors such as apparent severity, legal urgency, safety risk, repeated reports, and available information.

Where applicable law requires an explanation, complaint mechanism, or other procedural protection in connection with a moderation decision, CheckHer will provide it as required.

Logged-in users may use CheckHer's community reporting tools to report Experiences or comments that may violate the Community Guidelines.

A person does not need a CheckHer account to submit a legal, rights, privacy, or removal request through the public Report Content or Request Removal form. Submitting a report does not automatically result in removal. Reports are reviewed based on the information provided, applicable rules, and applicable law.

You must not knowingly abuse reporting systems, submit fabricated reports, impersonate a rights holder or representative, or knowingly provide materially false information in a report.

CheckHer may restrict or suspend an account when reasonably necessary to enforce these Terms or the Community Guidelines, protect users or third parties, comply with law, investigate abuse, or protect the security and operation of the service.

Serious violations may result in immediate action. Repeated violations may result in longer or permanent restrictions. Where required by applicable law, relevant procedural rights remain unaffected.

Account deletion and the handling of personal data following deletion are addressed separately in the Privacy Policy and by applicable data-protection law.

CheckHer may change, improve, secure, maintain, or discontinue features of the service. Temporary interruptions may occur because of maintenance, security incidents, third-party infrastructure, technical failures, or circumstances outside the operator's reasonable control.

Nothing in these Terms excludes mandatory rights that users may have under applicable law concerning digital services, service changes, defects, or non-performance.

CheckHer may rely on or integrate third-party infrastructure and services, for example for hosting, databases, authentication, media, or GIF functionality. Third-party services may be governed by their own terms and privacy practices where you interact with them directly.

Specific information about processors, recipients, transfers, and data handling belongs in the CheckHer Privacy Policy.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.

Subject to mandatory law, CheckHer is not responsible for the independent statements, opinions, conduct, or off-platform actions of users merely because users interact through or publish content on the service.

Statutory liability rules, including rules concerning intent, gross negligence, injury to life, body or health, mandatory consumer rights, and other liability that cannot lawfully be excluded or restricted, remain unaffected.

The processing of personal data is governed by the CheckHer Privacy Policy and applicable data-protection law. The Privacy Policy will explain, among other things, the purposes of processing, legal bases, categories of data, recipients, retention, user rights, and relevant third-party services.

These Terms do not replace the Privacy Policy or any legally required data-protection information.

To the extent legally permissible, these Terms and the contractual relationship concerning CheckHer are governed by the laws of the Federal Republic of Germany.

If you are a consumer, mandatory consumer-protection provisions that apply to you, including mandatory protections of the country in which you have your habitual residence where applicable, remain unaffected.

Nothing in these Terms removes statutory rights or remedies that cannot validly be waived or restricted by contract.

CheckHer may update these Terms when reasonably necessary, for example because the service changes, legal requirements change, new safety or moderation measures are introduced, or the Terms need clarification.

Material changes will be communicated in an appropriate manner where required. Any change to an existing contractual relationship remains subject to applicable law; merely publishing a new version does not override mandatory legal requirements concerning contractual changes.

The operator's legally required identity, address, and contact details will be provided in the CheckHer Impressum. Legal or rights-based content complaints can be submitted through the public removal-report form.

Do not place private contact details into public Experiences or comments when trying to contact CheckHer.
